Tinyspark, LLC (referred to as “Tinyspark” or just “we” or “us”) aims to safeguard your privacy while using our website, our mobile app, and our services. This privacy statement (our “Privacy Statement”) answers frequently asked questions about your online privacy, including what personal information we may obtain from you, how it will be used, and how it will be protected. 


This Privacy Statement applies equally to our website, www.lovetinyspark.com, our mobile app, and our services.


In this Privacy Statement, we use the term “personal information” to mean any information that can be used to identify, describe, relate to, be associated with (or be reasonably capable of being associated with) a specific individual. For example, personal information may include:

  • Your IP address, geolocation, user identification (if you register for any of our services), or similar information.

1. Personal Information We Collect


We collect personal information about you in three ways: 


Information you provide.


If you request any Tinyspark information or services, we typically ask you to provide us with personal information like your name, email address, a username, phone number, credit card or other billing information, and similar information that you will provide directly to us. 


Information we collect automatically.


While using Tinyspark’s website, mobile app, or our services, we collect a variety of personal information automatically.  The most common personal information we collect is technical data (IP address, browser information, cookies, web beacons, geolocation information, etc.) and information about your engagement with the website, mobile app, or services (such as your network activity, content you provide, content you access, content you block or reject, etc.). 


Information we receive from third parties.


Tinyspark works closely with integrated third parties to provide our services. Some of those third parties are selected directly by you (such as your email platform or content providers you select).  Some of those third parties are selected by Tinyspark to operate our services efficiently (such as our third-party payment processor or our website analytics services). We may obtain personal information about you from these third-parties to provide our services, enable certain features, update and improve our services, recommend aspects of our services we believe you may enjoy, and generally make sure you have a great experience with Tinyspark. 



2. How We Use Personal Information


We may use your personal information to:

  • Provide the Tinyspark services you request;
  • Communicate with you, or allow you to communicate with your fans or users;
  • Provide reporting or analytics to you or about your brand; 
  • Process your billing and payment information; 
  • Provide analytics and reporting internally to enhance our technology and services;

  • Operate our website, mobile app, and services;

3. How We Share Personal Information


We do not sell your personal information to any third party. However, to provide our website, our mobile app, and our services, we may share your personal information with:

  • Third parties approved by you, including integrated email platforms you choose for the Tinyspark services, content or brands you follow, or social media sites selected by you;
  • Our business partners and affiliates that help to deliver our website, mobile app, or services to you, such as our payment processing service or our website analytics provider;
  • Other third parties we use to help run our business, such as cloud-based website hosts or marketing agencies;
  • Our professional advisors, such as lawyers, accountants, or auditors, who are obligated to keep your information confidential; and
  • Law enforcement or other regulatory authorities (as necessary to enforce our Terms of Use, protect any individual user, or protect the safety and security of all users). 


We only allow our third-party service providers to handle your personal information if we are satisfied they take reasonable measures to protect your personal information, and we aim to provide the minimum amount of your information necessary for such third-party to deliver their services to us. We also impose contractual obligations on third-party service providers to ensure they can only use your personal information to provide services to us and to you. 


We may disclose your personal information without your prior permission to comply with applicable law or legal process (such as court or government subpoenas) or to federal or state law enforcement agencies in the detection or prevention of reasonably suspected crime.  We may disclose your personal information without your permission in special, limited cases. For example, we may have reason to believe that disclosing the information is necessary to identify, contact or bring legal action against someone who may be violating our Terms of Use, or may be causing intentional or unintentional injury or interference to the rights or property of Tinyspark, its customers, or any third-party service provider. 


In rare circumstances, we may need to share some personal information with other parties, such as potential buyers of some or all of our business or during a re-structuring. For these situations, we will typically anonymize and aggregate any personal information, but this may not always be possible. The recipient of the information will be bound by confidentiality obligations.


4. Privacy Policies of Third-Parties.


Third parties who are integrated with our services (such as your chosen email platform, our payment processing service, our cloud-hosting services, or our analytics service providers) may collect personal information about you. We are not responsible for the privacy policies or practices of such sites and the practices of these sites are not governed by this Privacy Statement. If you have questions about the privacy policies or practices of a third-party site, you should contact the site administrator or webmaster of the specific site. We may from time to time partner with other companies to offer co-branded services and promotions. Any information that you provide in connection with the co-branded services or any jointly sponsored promotions will become the joint property of Tinyspark and its business partners. We will maintain your information in accordance with the terms of this Privacy Statement. However, this Privacy Statement does not govern the privacy policies and practices of our business partners. If you have questions about the privacy policies or practices of our business partners, you should contact them directly.


5. Promotional Communications.


We may use your personal information to send you information about our website, mobile app, or services.  The communication may be by email, text message, phone, or via notifications in the mobile app. We also may use your personal information to recommend brands, content, or services offered by other Tinyspark users.


We have a valid interest in processing your personal information for promotional communications (see “How we use personal information” above). This means we typically do not need your consent to send you promotional communications. However, where consent is needed, we will ask for this consent separately and clearly (for example, we might ask you for your consent to send text messages in addition to emails).


You have the right to opt out of receiving promotional communications at any time by:

  • Contacting us at support@lovetinyspark.com ;
  • Updating your account profile to modify or change how we communicate with you and what we communicate; or
  • Using any applicable “unsubscribe” link in emails or the “STOP” number in texts sent to you. Please keep in mind that certain email communication and text communication may be provided by your selected email platform, and their privacy policies may also apply. 


We may ask you to confirm or update your communication preferences periodically to ensure we are communicating with you appropriately, or so that we may address changes in law, regulation, or the structure of our business.


6. Personal Information Collected or Shared in the Last 12 Months. 


This part of our Privacy Statement applies to consumers who reside in the State of California or Virginia.


We have not sold or shared any personal information to other businesses or third parties for monetary or other valuable consideration within the twelve (12) months preceding the effective date of this Privacy Statement, as those terms are defined under applicable state privacy laws. 


We may have disclosed personal information to our service providers for business purposes in the prior twelve (12) months. The information we have disclosed for business purposes may include some or all of the categories listed below. For more details on how we share personal information, please see “How We Share Personal Information” above.


In the preceding 12 months, we may have obtained the following categories of personal information:

  • Specific Identifiers (e.g., name, email, physical address, user ID, IP address, or other similar identifiers)
  • Information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to, their name, physical characteristics or description, address, telephone number, credit card number, debit card number, or any other financial information necessary to process billing and payment information)
  • Characteristics of protected classifications under California or federal law
  • Commercial information (e.g., records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies)
  • Biometric information
  • Internet or other electronic network activity information (e.g., browsing history, search history, and information regarding a consumer’s interaction with an internet website, mobile application, or advertisement)
  • Geolocation data
  • Audio, electronic, visual, or similar information
  • Professional or employment-related information
  • Inferences drawn from any of the information identified above to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes

7. Your Rights 


You may request access, correction, export, or deletion of your personal information, or you may request to opt-out of sharing targeted advertising or automated decision making where applicable under state privacy laws. In certain states (including Virginia, Colorado, Connecticut, and Utah), you also may  have the right to appeal if we deny your request to exercise your privacy rights. We will respond to your appeal within 45 days of receipt.


We will keep your personal information while you have an account with us or while we are providing services to you. Thereafter, we will keep your personal information for as long as is necessary:

  • To respond to any questions, complaints or claims made by you or on your behalf;
  • To show that we treated you fairly; or
  • To keep records required by law.


We will not retain your personal information for longer than necessary for the purposes set out in this Privacy Statement. When it is no longer necessary to retain your personal information, we will delete or anonymize the information.

We implement and maintain reasonable security procedures and practices appropriate to the nature of the personal information we collect and maintain, but no system is fully secure. 


We maintain reasonable administrative, technical, and physical safeguards for our website, our mobile app, and our services designed to protect against loss, misuse or unauthorized access, disclosure, alteration or destruction of the personal information we receive or collect. However, any software provided over the Internet creates inherent information security risks, and we are not able to guarantee your security.

Tinyspark uses cookies and analytics on our website, our mobile app, and in connection with our services. 


We use these cookies for a variety of reasons, but most commonly to distinguish you from other users and to help us compile aggregate statistics about usage of our site, our mobile app, and our services. We also use cookies to help us provide you with a positive experience when you browse our website, help improve our content, and to personalize your visit.


Types of Cookies

  • Session Cookies:  These cookies are used to maintain your transaction. Generally, your session cookies expire when your browser is closed. The use of the session cookies reduces the need for Tinyspark to transfer your information over the Internet.

  • Analytics Cookies: These cookies are used to collect information about how visitors use our website, our mobile app, and our services.   • Remarketing Cookies: We may use remarketing cookies or remarketing pixels to help identify visitors of our website or mobile app, and to direct our marketing content to such visitors. Visitors to our website or mobile may opt out of the use of cookies for remarketing by visiting the Google Marketing Platform opt-out page or the Network Advertising Initiative opt-out page.
  • Third-Party Tracking or Remarketing Cookies: We have relationships with other carefully selected partners to assist in the delivery of a quality Site. We may use tracking cookies and remarketing cookies provided by our partners to track your movement between our Site and other websites and to better target content, marketing, and advertisements that may be of interest to you. We do not have access or control over the cookies and similar technologies that our partners may use.

Please note that our website and our mobile app are not designed to respond to “do not track” requests from web browsers.


Use by Minors


Tinyspark is not intended for use by children under 13. If we learn we have collected such data, we will restrict or delete the data.

We may update this policy and notify you via the mobile app or email if material changes occur.
